APS is not the employer of offshore staff unless explicitly stated in an executed EOR contract.
For non-EOR offshore employee management:
- Employees remain under the administrative employment of APS/KC
- Clients direct day-to-day work
- APS is not liable for work output, decisions, or actions taken by the employee
For EOR services:
- APS/KC handle payroll, compliance, HR administration
- The client controls duties, tasks, and work performance
- APS/KC are not responsible for client-led disciplinary decisions
- Client is responsible for ensuring lawful, non-discriminatory work direction
