Processing For Employment & Staffing Purposes

We may process:

  • Payroll and tax data (for EOR workers)
  • Interview notes and assessment results

This processing is required for service delivery.

Retention for Employment-Related Data

Staffing and EOR-related data may be retained for 7 years to comply with:

  • U.S. employment laws
  • Payroll and tax obligations
  • Audit requirements
  • Legal defense purposes

EOR & Offshore Employment Legal Disclaimer

APS is not the employer of offshore staff unless explicitly stated in an executed EOR contract.

For non-EOR offshore employee management:

  • Employees remain under the administrative employment of APS/KC
  • Clients direct day-to-day work
  • APS is not liable for work output, decisions, or actions taken by the employee

For EOR services:

  • APS/KC handle payroll, compliance, HR administration
  • The client controls duties, tasks, and work performance
  • APS/KC are not responsible for client-led disciplinary decisions
  • Client is responsible for ensuring lawful, non-discriminatory work direction
